Welcome to Nowful! These Terms of Service (“Terms”) govern your access to and use of the Nowful mobile application (the “App”), the Nowful Shopify store at nowfuljourney.com (the “Store”), and any associated products, content, and features (collectively, the “Services”).

By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

 

 

  1. ELIGIBILITY

You must be at least 18 years old to use the Services. By using the Services, you represent that you are of legal age to enter into a binding agreement.

 

 

  1. ACCOUNT REGISTRATION & SECURITY

Some features require you to create an account. You agree to:

  • Keep your login credentials confidential.

The Nowful App and related products are intended for lifestyle and wellness support. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. You acknowledge that:

  • Our Services are not a substitute for professional medical or psychological care.

  • We do not guarantee any specific health or wellness outcomes.

Consult a qualified healthcare provider for medical advice.

By engaging in this product you are waiving any and all health issues that could emerge from this experience, whether physical or mental, including but not limited to injury and death, and you hereby waive any and all liability of Nowful in connection with your use of these products and services.

 

 

  1. PURCHASES, PAYMENTS & REFUNDS

When you purchase products or services through the Store:

  • Prices are subject to change without notice.

  • We may refuse or cancel any order.

  • Payments are securely processed by third parties (e.g., Shopify Payments, Stripe, PayPal).

  • Refunds are subject to our Return Policy, posted on nowfuljourney.com.

 

 

  1. SUBSCRIPTION BILLING

Some features may be offered via recurring subscriptions. By subscribing, you agree to:

  • Automatic Renewal: Your subscription will auto-renew unless canceled before the end of the current billing cycle (monthly or annual).

  • Consent to Charge: You authorize us or our payment provider to charge your payment method on a recurring basis until canceled.

  • Clear Disclosure: Subscription terms, pricing, and renewal frequency will be displayed prior to purchase.

  • Cancellation: You may cancel at any time through your account settings or by emailing hi@nowfuljourney.com.

  • Refunds: Subscription fees are non-refundable unless required by law or stated in our refund policy.

  • Notice of Price Changes: We will notify you in advance of any price changes. Continued use after notice constitutes acceptance.

These terms comply with applicable U.S. Automatic Renewal Laws (e.g., California Business & Professions Code ¦1751).

All content in the Services (text, logos, graphics, software, etc.) is owned by Nowful or licensed to us. You may not use, copy, or distribute our content without written permission.

 

 

  1. USER CONTENT & LICENSE

You may submit personal reflections, journal entries, or chat messages. By submitting content:

  • You retain ownership.

  • You grant Nowful a non-exclusive, royalty-free, worldwide license to use, display, and store the content solely to operate and improve the Services.

  • You confirm you have the rights to submit this content.

AI responses may be generated based on your content. These responses are automated and not reviewed by a human.

 

 

  1. THIRD-PARTY SERVICES

We may link to or integrate with third-party services. We do not control these services and are not responsible for their practices. Your use of third-party services is at your own risk.

 

 

  1. DISCLAIMERS

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy or effectiveness of content, including AI-generated suggestions

We do not guarantee uninterrupted, secure, or error-free operation.

To the extent permitted by law, Nowful and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

Your sole remedy is to stop using the Services.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Nowful and its affiliates, directors, officers, and employees from any claims or damages arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Any violation of law or third-party rights

 

 

  1. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of [Insert State].
